Refunds are governed by our Refund Policy, available on this Site.

Unauthorized distribution may result in access revocation and legal action.

Our Site may integrate or link to third-party services, including but not limited to payment processors, email platforms, cloud hosting providers, embedded content platforms, analytics tools, communication platforms, and artificial intelligence tools.

We are not responsible for the privacy practices, security practices, terms, policies, or actions of third-party services.

We do not guarantee specific outcomes, performance improvements, or operational results. Implementation decisions are the responsibility of the participant or organization unless otherwise stated in a separate written agreement.

9. Professional Services Disclaimer

Better Resilience, LLC provides consulting, governance guidance, preparedness education, communications readiness, continuity planning, and risk management advisory services. All materials and services are provided for informational and educational purposes only.

Nothing provided through the Site or consulting engagements constitutes legal advice, financial advice, emergency management direction, regulatory representation, or professional representation. No attorney-client relationship is formed unless explicitly established through a separate written agreement signed by both parties.

10. Use of Artificial Intelligence

Better Resilience, LLC may use artificial intelligence (“AI”) tools and other automated technologies to assist in developing educational materials, documentation, research, analysis, communications, software, templates, reports, and consulting work products.

AI tools are used as productivity, drafting, research, analytical, or quality-support aids. Deliverables are subject to human review, editing, and professional judgment before being provided to clients or published through the Site.

Unless otherwise agreed in writing:

  • Better Resilience, LLC retains responsibility for the work products it delivers to clients.

  • AI systems are not authorized to make final decisions on behalf of clients.

  • Clients remain responsible for reviewing and approving recommendations before implementation.

  • Confidential or sensitive information will only be processed using tools that Better Resilience, LLC determines are appropriate for the sensitivity of the information provided.

Nothing in this section creates any warranty regarding the accuracy, availability, performance, or security of AI-assisted tools.

11. Confidentiality and Client Information

In connection with inquiries, purchases, consulting engagements, or training activities, you may provide information to Better Resilience, LLC. We will use reasonable care to protect non-public client information shared with us.

Unless governed by a separate written agreement, you should not submit highly sensitive, regulated, classified, privileged, or legally restricted information through the Site or ordinary electronic communications.

Confidentiality obligations, if any, for consulting engagements may be further addressed in a separate written agreement, statement of work, or master services agreement.

12. No Reliance

Clients and users are solely responsible for independently evaluating and implementing any recommendations. Better Resilience, LLC does not assume responsibility for regulatory compliance, legal interpretation, operational decisions, emergency response decisions, or the consequences of implementation.

Better Resilience, LLC may employ a variety of analytical methods, software tools, and technologies, including artificial intelligence, to assist in developing recommendations. Clients remain solely responsible for evaluating whether any recommendation is appropriate for their specific circumstances.

13. Assumption of Risk

Preparedness training, emergency planning, communications exercises, field activities, tabletop exercises, and related activities may involve inherent risks. By participating in any training, consulting, or activities associated with Better Resilience, LLC, you acknowledge and voluntarily assume such risks. Participation is undertaken at your own discretion and responsibility.

14. Limitation of Liability

To the fullest extent permitted by law, Better Resilience, LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to:

  • Use of this Site

  • Participation in training

  • Implementation of provided materials

  • Temporary unavailability of the Site

  • Loss of profits, revenue, business opportunity, goodwill, data, or business interruption

Your use of the Site is at your own risk. In no event shall the total liability of Better Resilience, LLC exceed the amount paid for the specific product or service giving rise to the claim.

This limitation applies regardless of the legal theory asserted, whether in contract, tort, negligence, strict liability, or otherwise, even if Better Resilience, LLC has been advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations of liability; in such cases, liability shall be limited to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Better Resilience, LLC from any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising from your misuse of the Site, violation of these Terms, unauthorized use of our materials, or implementation of materials or recommendations in a manner inconsistent with applicable law or your own responsibilities.

16. Dispute Resolution

The parties agree to first attempt to resolve any dispute through good-faith negotiation prior to initiating formal legal proceedings.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Tennessee.

We reserve the right to modify or discontinue any portion of the Site and to update these Terms at any time.

Continued use of the Site after updates constitutes acceptance of the revised Terms.
